Terms of service

At Ginny Garden, every order begins with a shared understanding of the natural world. Whether your plant is traveling across Bangkok, flying across the globe, or being handed over directly at an event, handling living art requires precision and trust. By confirming your order, you agree to the following commitments—designed to protect both the welfare of the plants and the integrity of our partnership.

1. Exact Plant Representation: Throughout our store, the images shown represent the exact plant you will receive. If a listing ever differs from this standard (such as a grower’s choice cutting), it will be explicitly stated in the product description.

2. Natural Variation & Development: Living plants evolve daily. Minor natural variations in leaf shape, color, and venation are entirely normal, and your plant will continue to develop its unique character once it settles into its new space. Please also keep in mind that depending on your screen settings, the actual color and texture of the plant may appear slightly different from the digital images. We ask that you review all photos carefully before completing your order.

3. Address Accuracy & Delivery Success: The swift and safe arrival of living art relies entirely on precise shipping details. We ask that you carefully double-check your address and contact information at checkout. Ginny Garden cannot be held responsible for extended transit times, delivery failures, or resulting plant stress caused by incorrect or incomplete address entries.

4. Finality of Sale: At Ginny Garden, we specialize in cultivating rare plants. Because our plants are living organisms that experience natural stress during transit, they cannot safely survive the journey of being shipped twice. To protect the welfare of these delicate specimens and ensure immediate processing, all sales are final upon payment, and we are unable to accommodate cancellations, returns, or exchanges for subjective reasons.

5. International Customs & Import Permits: For our global collectors, it is your sole responsibility to verify your local import regulations before placing an order. If your country requires an Import Permit, you must provide it to us before the package leaves Bangkok. Ginny Garden is not liable for packages delayed, opened, confiscated, or destroyed by your local customs authority due to missing permits, unpaid duties, or unexpected agricultural policy changes. In these events, the Live Arrival Promise (detailed in Section 8) is voided.

6. Our Pre-Shipment Health Guarantee: Plant viability is our absolute priority. If, during our final pre-packing evaluation, we determine that a plant is no longer in stunning condition or strong enough for the journey, we simply will not box it. In this rare event, we will notify you immediately and issue a full refund for that specific specimen.

7. Transit Risk & "Botanical Jet Lag": Travel is a significant transition for living organisms. By ordering, you acknowledge that "Botanical Jet Lag"—which may include cosmetic yellowing foliage, dropped leaves, or minor root stress—is a natural part of the transportation process and does not constitute a damaged or dead plant. While we ensure every specimen leaves our care in peak condition, we cannot be held responsible for uncontrollable carrier delays, extreme weather, or customs holds. (For care tips upon arrival, please review our 5 Steps to Beat Shipping Stress guide).

8. The Live Arrival Promise & Claims: We define "Live Arrival" strictly as a plant delivered capable of resuming healthy growth.

  • The Claim Process: In the rare event a plant arrives structurally compromised or dead upon arrival, you must contact us within 24 hours of receiving the package. To help us accurately assess the plant's condition, you are required to provide a continuous, unedited unboxing video.

  • Resolution: If the plant fails to meet our Live Arrival standard due to factors within our control prior to carrier handover, we will work with you directly to provide expert recovery guidance or negotiate a fair and reasonable solution based on the specific circumstances.
